Nine defendants appeared in court Thursday, March 30
Correctional of Auxerre, for having, on December 11 and 12, 2001, occupied
a secondary residence of Thierry Desmarest, CEO of Total, in
Montigny-la-Resle (Yonne).

These Breton and Toulouse activists intended to protest against
the attitude of the oil group and its boss after the oil spill
the Erika in December 1999 and the explosion of the AZF factory in September
2001. They were tried for "home invasion", "aggravated theft" and
"serious degradations". Thierry Desmarest, who had been cited as
witness for the defense, estimated in a letter that his presence was
"useless in the manifestation of the truth".

And the truth was indeed revealed without pain. The defendants have
admitted to having entered, "through the door", into the castle, where no one was
while a caretaker. They admitted having brushed "ERIKA" and "AZF" on
the walls, with oil brought from the Breton coast. "We got good
tagged 450 kilometers of coastline ", justified Alain Malardé,
spokesperson for the Maritime Confederation.

The activists dismantled shutters and windows of the castle in order to "de
reproduce the situation experienced by Toulouse victims ", according to
Claire Poinas, member of the collective Never again. "At night we
did not feel hot: the thermometer went down to - 4 degrees ", a
added Jo Le Guen, head of the Keep it Blue association.

The discussions, conducted with placidity by President François Arnaud, have
especially focused on "aggravated theft", namely the consumption of twelve
bottles of Bordeaux wines taken from the cellar.

Alain Malardé: "But the gendarmes took the hit with us."
Robert Prigent, another defendant from Brittany: "They are even the ones who
drank the most! "
The President: "Who owned these bottles?"
Defense lawyer Emmanuel Riglaire: "There was no
invoice, maybe it was Elf. "

The President: "How was the gripping of the bottles done?"
Alain Malardé: "One in each hand, Mr. Chairman."
The same: "We also served ourselves in the fridge."
The Chairman: "I am not seized of this point."
Alain Malardé: "It is nevertheless important, no wine without cheese."
Jo Le Guen: "We folded the rugs when we arrived."
Alain Malardé: "And we did the dishes before leaving."
The Chairman: "Did you also raise the shutters?"
Alain Malardé: "No, but they hadn't done it in Toulouse either."

The debate soon took a more serious turn. The defendants pleaded
"the militant gesture" and "the union act". "I take responsibility
whatever it costs me, which is not the case with Total ", assured
Claire Poinas, evoking the dead and the wounded crippled for life
Toulouse.

With the exception of Alain Malardé, a recidivist of this kind of action,
wine drinkers had no lockers. Believing that there was a
"minimal damage" and admitting "union reason", the public prosecutor
République, François Perrin, requested that the offenses be reclassified
in contraventions and are thus covered by the amnesty. For the
defense, Me Emmanuel Ludot pleaded the release and assured that there was
not robbery but rascality, "since the bottles have not left the
castle".
