The Wise Men validated the law establishing the extension of the health pass and compulsory vaccination of caregivers, but nevertheless censored certain measures, including the early termination of the fixed-term contract or compulsory isolation.
Last step before the entry into force of the controversial bill relating to the management of the health crisis, the decision of the Constitutional Council was particularly awaited. On August 5, the Wise Men validated the law establishing the extension of the health pass, in particular for cafes, restaurants or even in hospitals, if its use does not “obstruct access to care”. This measure should therefore officially enter into force on August 9, as the government announced several days ago. Compulsory vaccination for certain professions, including caregivers, has also been validated.
On the other hand, several measures were censored by the Council, such as in particular the provisions relating to the compulsory isolation of people diagnosed positive for Covid-19, which for example provided for a drastic strengthening of controls. The Wise therefore consider that this device is neither "necessary, appropriate [nor] proportionate" and that it constitutes a measure depriving of liberty "without an individual decision based on an assessment of the administrative or judicial authority".
The health pass: symbol for opponents of restrictions
In the viewfinder of opponents of anti-Covid restrictions, notably the vaccination obligation, which triggered strike notices in hospitals or firefighters, but especially the health pass.
The latter, which takes the form of a QR code, can be obtained through a full vaccination, a certificate of remission from Covid-19, or a negative test. On July 12, during a televised address, Emmanuel Macron had shown the desire to force as many French people as possible to be vaccinated by the need to present the health pass in any place open to the public with a gauge of 50 people, the shopping centers of more than 20 square meters or some public transport such as airplanes. People in contact with vulnerable groups such as healthcare staff will be obliged to be vaccinated. These new provisions conflict with the pledges given on several occasions by Emmanuel Macron himself and his parliamentary majority.
This announcement of the extension of the health pass from July 17 provoked numerous demonstrations throughout France. Demonstrations that have been repeated regularly since, such as that of July 31, which brought together more than 200 people in Paris (according to estimates by the Ministry of the Interior) and in more than 000 cities in France. The extension of the health pass was validated by the Council of State on July 150, the latter having on the other hand made reservations, in particular on the issue of shopping centers.
The bill "relating to the management of the health crisis" was adopted on July 25 by the Senate and finally the National Assembly a few hours after an agreement between deputies and senators gathered in a joint committee. The vote on this law had led to strong reactions from the opposition on the right and on the left, with the former MEP Florian Philippot qualifying it for example as "the most anti-humanist and liberticidal law there is", while the leader of the rebels Jean-Luc Mélenchon deplored a text which “changes the nature of the society in which we want to live”.
On July 26, 74 deputies from the Democratic and Republican Left, Insubordinate France, Socialists and Allies and Liberties and Territories groups seized the Constitutional Council about the health bill. Also seized by Matignon, the Sages of the rue de Montpensier rendered their decision on August 5.
Several unions have also called for an indefinite strike from August 4 to mobilize against the compulsory vaccination of nursing staff which will be effective from September 15. From this date, it will be possible to suspend employment contracts, or even to initiate dismissal procedures against those who have not fulfilled this obligation. The FA SPP-PATS, one of the main firefighters' unions, also filed on August 4 a notice of an indefinite national strike which will begin on August 9, the date on which the vaccination obligation imposed on their profession will come into force.
