Indeed the principle of retroactivity is unacceptable.

Indeed, the legislator assumes that a judicial sanction is not only repressive but also dissuasive. Example: if you know that your head will be cut off if you kill your mother-in-law, "we" hope that you will give it up. And that's what most reasonable citizens do.

It can therefore be implicitly assumed that those convicted who are currently in prison have "accepted" the risk of the sentence they are currently serving in committing their crime. This risk there, but not another. We cannot therefore lengthen their sentence if they have not committed other acts since the acts for which they are being prosecuted.

To compare: would you agree to pay for a more expensive product when you ordered it on a specific date, at a specific price, precisely because it was at that price? No, isn't it!
