Damage Work Abuse Waiver Clause ??

Hello
I built a house 5 years ago with a builder and am covered by structural damage insurance.
Disorders have appeared and are taken into account by the insurance.
This insurance asks me to send it back a document called "subrogative receipt" before the regulation which states:
" I formally declare that I waive any subsequent, amicable or legal claim on the occasion of this incident and its consequences. and subrogates Company XXXXX in all my rights and actions "

The subrogation is normally made automatically as soon as the payment is made by the insurance company so according to my information there is no need for this subrogative receipt BEFORE the payment.

The insurance company includes a waiver clause while the ten-year guarantee (and DO) will still be valid for 5 years.
Is this clause not abusive ??
