LuxLeaks: Antoine Deltour in prison?

by Christophe » 30/04/16, 11:56

The prison and a heavy fine threaten Antoine Deltour for having denounced some tax optimization practices in Luxembourg by multinationals ... Novethic has put together a small interesting file on the subject of optimization (new term for evasion ???) tax for large companies ...

Multinational companies choose to artificially locate their profits in countries where the taxation is most favorable to them, rather than in the countries where they create value. These aggressive tax optimization practices, often on the verge of legality, are severely judged by public opinion around the world and increasingly opposed by states.

The following...

18 months (with possible stay) and fine (certainly high) for telling the truth, the journalist from France2 is also worried:

(...)
Regarding MM. Deltour and Halet, the prosecutor accepted all the grounds for indictment ("theft", "violation of business secrets" and "professional secrecy", "fraudulent access to a computer system" and "money laundering"). He demanded a fine and eighteen months' imprisonment against them, not "opposing" the conditional sentence. For Mr. Perrin, he requested a simple “fine”, agreeing that he had pursued a legitimate reason for information, but using means, according to him, constituting an complicity of “violation of business secrets and professional secret ".

Virtue is not of this world.
They would have been wrong not to take advantage of it since the Tax Rescript was legal https://fr.wikipedia.org/wiki/Rescrit#Rescrit_fiscal
However, it should be noted that Mr. Penning is not the lawyer directly identified as an intermediary in the context of the constitution of these companies. It is that of one of his associates

Was it? It still is not? This is why these "panama papers" are a vast media hypocrisy ... nothing will change anytime soon!

Besides, yesterday I made an order on Amazon with a rate of VAT invoiced (except bug?) Frankly low, explanations here: economy-finance / Luxembourg-amazon-bills-the-vat-a-1-6-t14720.html

Reading the Declaration of Human Rights is very clear on this subject: the rights of the individual coexist with those attached to property, this introduces a significant limitation, not to say a contradiction, and the current trial shows which side is tipping the balance ...
