The case was filed on January 25 and published on the public register of the Court of Justice of the European Communities on Monday, but detailed information is not yet available online. Two people with knowledge of the matter confirmed the details of the case to POLITICO.

The New York Times declined to comment on the case. A statement from the publication reads, "The Times is filing numerous freedom of information requests and maintains an active case. We cannot comment at this time on the subject of this lawsuit."

The European Commission did not immediately respond to a request for comment.

The legal action follows an investigation by the European Ombudsman, Emily O'Reilly, from January 2022, which identified maladministration in the Commission's attempts to recover the text messages, following an access request audience of netzpolitik.org journalist Alexander Fanta. The Ombudsman's inquiry revealed that the Commission did not explicitly ask the President's personal office to search for the text messages.

In response, the European Commissioner for Values ​​and Transparency, Věra Jourová, said that the SMS could be deleted, due to their "ephemeral nature".

German daily Bild previously filed a series of lawsuits against the Commission seeking disclosure of documents relating to the purchase negotiations for COVID-19 vaccines made by Pfizer/BioNTech and AstraZeneca.

Although several of its requests have been denied by the courts, Bild – which, like POLITICO, is owned by publisher Axel Springer – has obtained certain documents relating to the talks, including email correspondence from June 2020. No information on Ms von der Leyen's prior contacts with Pfizer CEO Mr Bourla, however, were only revealed following Bild's legal action.
